How to: Transferring an existing listing to another brokerage firm
This set of general instructions applies to Rental listings and For Sale listings.
When can a listing be transferred?
- Existing Brokerage Firm closed, and the Agent wants to transfer their listing to a new Firm.
- Listing Agent changed Brokerages and wants to transfer their listing to the new Firm.
Option A
- Cancel the existing Listing Contract and change the listing status in the MLS to Cancelled.
- Execute a new Listing Contract under the new Brokerage Firm, and market the property in the MLS as a new listing.
Option B
If the Seller does not want to sign a new Listing Contract, HiCentral MLS can transfer the existing listing to the new Brokerage Firm. For the transfer, please submit these 2 forms to the MLS Client Care Team (techsupport@hicentralmls.com):
MLS Change Form:
- Complete the top section
- Complete the bottom section:
- Existing PB/BIC must sign & date this form to authorize HICMLS to transfer this listing*.
- New Office Code and New Member MLS ID # must be clearly stated in the Transfer Listing section of the form.
- The PB/BIC of the new firm must sign & date the Transfer Listing section of the form.
Amendment to the original Listing Contract:
- To amend the listing brokerage information to reflect the new firm. This form must be signed by the current Brokerage Firm and the Seller.
Note:
- The Amendment is the doc that shows the agreement b/w the original (current) Brokerage Firm and the Seller to change the Brokerage to the new firm.
- The MLS Change Form is the doc that shows the agreement b/w the 2 firms: Original firm to release the listing and new firm to accept the listing.
*If an offer has been accepted, permission from Escrow to transfer the listing will also be required.
When the listing status is Active Under Contract or Pending, we cannot transfer the listing unless escrow granted permission. At first, ask the member to send us an email showing escrow's permission (screenshot of an email or a doc is sufficient). Upon receipt, send instructions to the member for the docs they need to submit for the listing transfer.
Notes:
- The Change Form is a request form, it is not to be used to amend any contracts.
- The releasing or receiving brokerage firm can submit the change form.
- Penalties for existing listing violations shall remain with the releasing brokerage firm.
- Bulk transfers for all listings under one office to another office will be handled by the MLS Compliance Team.
