Do I need a Listing Agreement to list my own property in the MLS?
Case: The Listing Agent is the Seller/Owner of the subject property.
1. If the Listing Agent is also the Listing Brokerage Firm's owner, HICMLS does not require a signed Listing Contract.
2. All other cases - Listing Contract is required in order to list in the MLS.
This is because the firm owns the listing; thus, the agent must have a signed agreement with their Brokerage Firm. And, MLS has a field that discloses the type of contract for the listing:
- ER - Exclusive Right-To-Sell
- EA - Exclusive Agency
In general, when there is a Listing Contract - an Amendment form is used to change contract terms.
